Elhagyottnak nyilvánítás, avagy igény az állami gyermekmenhelyek kötelékébe történő felvételre
Abstract :
A dualizmus kori állami gyermekvédelem fő célja a gyermekhalandóság csökkentése, valamint a gyermekek züllésének visszaszorítása volt. A szegényügytől eltávolodva az állami gyermekvédelem intézményrendszere az állami gyermekmenhelyek kiépülésével vált teljessé a 20. század első évtizedének végére. Az állam általi gondozásra, nevelésre, eltartásra való jogot a gyermek hatóságilag elhagyottnak nyilvánítása keletkeztette, amely eljárás lefolytatása 1903-tóltartozott az árvaszékek hatáskörébe. A források alapján arra lehet következtetni, hogy a jogalkalmazás során az elhagyottnak nyilvánításra irányuló eljárásban a gyermek elhagyottságát megalapozó tények vizsgálata esetenként felületes volt. Ugyanakkor a levéltári források alapján a gyermekek érdekét szolgáló intézkedések gyakorlati megvalósulása nyomon követhető.
The main goal of child protection of the royal Hungarian state during the age of dualism was to reduce child mortality and prevent child delinquency. The system of public child protection was completed by the establishment of state-maintained children’s asylums by the end of the first decade of the 20th century. The right to receive care, education and maintenance from the state was based on the declaration of abandonment, which was the duty of the court of wards from 1903. The conclusion can be drawn that the application of the law in proceedings for the declaration of abandonment, the examination of the circumstances justifying the abandonment of the child was in some cases superficial. On the other hand, the archive sources show that actions in favour of children were implemented in practice.
