A kár fogalmának meghatározása az 1940-ben visszatért országrészek kárenyhítési eljárásaiban
Abstract :
A második bécsi döntés révén visszatért területek lakosságában méltányolható igény keletkezett a román fennhatóság idején őket ért sérelmek orvoslására. A kormány ezt szem előtt tartva alkotta meg az 1440/1941. M. E. számú rendeletet, amelynek 7. §-a méltányos kárenyhítés megítélését tette lehetővé azok számára, akik az értékviszonyok rendezetlensége miatt a valóságos értékük alatt tudták eladni ingatlanaikat, vagy elvesztették azokat. A kár fogalmának meghatározásában jelentős eltérések mutatkoztak az egyes bíróságok között, amelyeket először az érintett négy ítélőtábla értekezlete, majd a kormány kiegészítő és értelmező rendeletei próbáltak feloldani. A gyakorló jogászok számos tanulmányban tették közzé a rendelet értelmezésével kapcsolatos nézeteiket, ezzel segítve a jogalkalmazást. Minden nehézség ellenére kijelenthető, hogy a rendelet megalkotása szükséges volt, és a hasonló esetekhez mintaként szolgál az alkalmazása.
A fair demand arose on the side of the people who lived in the territories returned to Hungary through the Second Vienna Award to get redress after the grievances they had had during the period of the Romanian supremacy. With that in mind, the Hungarian Government adopted Decree 1440 of 1941, the paragraph 7 of which allowed to award fair compensation for persons who lost their real properties or could only sell them at a loss due to the fluctuation of the sale value. Significant discrepancies were shown among the courts regarding the concept of this type of damage. At first the conference of the concerned four courts of appeal, subsequently the complementary and interpretive decrees of the Government tried to solve the problem. Legal practitioners published their opinions concerning the interpretation of the decrees in several essays, in order to support the adjudication. In spite of all difficulties it is ascertainable that the adoption of Decree 1440 of 1941 was necessary, and its application serves as a sample for similar cases.
