Az ítélkező bírák titkos minősítése 1891 és 1913 között

Abstract

A tanulmányban a bírák korabeli minősítési rendszerét és annak szakmai sajtó­visszhangját tekintem át. A bírák minősítését a szolgálati felettes a személyi táblá­zatokban a „Hivatali jegyzék”, majd a „Hivatalos jegyzetek” rovatban rögzítette, azonban a minősítés eredményét a bírák nem ismerhették meg. Az áttekintés során először a tárgybeli bírói ügyviteli szabályokat, majd az 1891 és 1913 között hatályos rendelkezéseket vizsgálom meg, ideértve Szilágyi Dezső és Plósz Sándor rendelke­zéseit a bírák személyi táblázatairól. Ezt követően a bírák titkos minősítését tárgyaló szaktudományi és hírlapi viták főbb csomópontjait foglalom össze, majd a minősítés­ről szóló titkos miniszteri rendeletet elemzem. A minősítések a szolgálati előmenetel fontos elemei voltak, azonban titkosításukat a korabeli szaklapokban számos kritika érte, amelynek Balogh Jenő igazságügyminiszter 62.500/1913. I. M. számú rendelete vetett véget, ezért a tanulmányt e rendelet ismertetésével zárom.

In this study I examine the system of the quality reports written about the judges and its press coverage. The quality reports were recorded by the superior of every judge in the personal records under the “Public Office Notes”, later the “Official Notes” section. However, the judges were not allowed to have an insight into the exact content of the quality reports. Over the course of the study, I analyse the regulation of the Code of Judicial Conduct, then I observe the regulations from 1891 to 1913 including the decree of Dezső Szilágyi and Sándor Plósz relating to the personal records of the judges. After that, I summarise the main points of the disputes about the confidential quality reports published in the scientific journals and other newspapers. Next, I take a closer look at the confidential ministerial decree on the quality reports. Considering the carrier of the judges, these reports were indispensable to progress; however, the confidential status of the reports was widely criticised in the scientific journals. The reports ceased to be confidential due to Decree 62.500/1913 issued by Jenő Balogh, Minister of Justice. I will therefore conclude the study by presenting this decree.
