Abstract

A fenntarthatóság napjainkban új paradigmaként jelenik meg a jogtudományban is. A gazdasági, környezeti, és társadalmi fenntarthatóság mellett a jog fenntarthatóságáról, és a fenntarthatósági jogról is szükséges gondolkodni. A jog és a fenntarthatóság kapcsolata nem érthető meg a házasság, a család, a magántulajdon, az állam kialakulása, kezdetei, szerepük ismerete nélkül. Az állam a nemzetségekké vált családokra épült. A család kiemelkedő szerepet töltött be a tulajdoni viszonyok területén a társadalom és a gazdasági rendszer alapegységeké nt. Az állammá alakulás döntő motívuma a tulajdon védelme volt. A tulajdon védelmét a család, mint közösség gyakorolta. Az állam összetartó ereje a tulajdon. Ma a házasság, a család, a magántulajdon, az állam jogintézménye egyaránt politikai támadás alatt áll. Sorsuk senki számára nem lehet közömbös.
