A német párttörvény reformja
Absztrakt :
A pártok alaptörvényi szinten történő szabályozása nagy előrelépésként értékelhető, hiszen Németországban még a két világháború között is volt rá példa, hogy az alkotmányjogi irodalomban a pártokat „extrakonstitucionálisnak”, vagyis alkotmányon kívülinek bélyegezték, illetve A Német Birodalom Alkotmánya (Die Verfassung des Deutschen Reichs), ismertebb nevén a weimari alkotmányban még csak említés szintjén kaptak helyet a pártok, miszerint „a hivatalnokok a közösség, s nem egy párt szolgái”.
The regulation of parties at the level of the Basic Law can be seen as a great step forward, since in Germany, even between the two world wars, there were examples of parties being labelled „extra-constitutional”, i.e. outside the constitution, in the constitutional literature. Additionally, in the Constitution of the German Reich (Die Verfassung des Deutschen Reichs), better known as the Weimar Constitution, parties were only mentioned in the statement „officials are servants of the community, not of a party”.
