Abstract

This paper explores some form of discrimination in Roman law. It understands discrimination as a special form of preference. For this reason, its methodology makes use of the law and economics approach. First, it tackles the problem of the difference between the salaries of employees belonging to different genders and later argues that the presumed hierarchy within the ancient Roman marital relationships was not that simply granted as former scholarship assumed. The second main topic is racism. In this part of the essay, the System 1 and 2 thinkings are intro - duced as explanatory devices. Linked to this approach based on thinking fast and low, the paper gives a new interpretation to a famously enigmatic fragment about the so-called Saufeius-affair. In the closing section, it briefly describes a few examples of what we can qualify as ancient Ro - man 'affirmative actions'.
