A beismerő nyilatkozat jogintézményének értelmezési nehézségei

Abstract

Az új büntetőeljárási törvény jelentős újítása az előkészítő ülés újraszabályozása, amelyen immár lehetőség van az eljárás gyors és végleges lezárására. Ennek feltétele egy érvényes vádlotti beismerő nyilatkozat, amelyet a bíróság a törvényben meghatározott feltételek és egyéb tényezők figyelembevétele alapján, egy erre irányuló kihallgatást követően értékel. Kérdéses azonban, hogy a jogalkotó által „beismerő nyilatkozatként” meghatározott terhelti közlés és az azt követő, bíróság általi „kihallgatás” hogyan viszonyul a terhelti vallomás törvényben meghatározott fogalmához, illetve a büntetőeljáráson lefolytatott, bíróság általi bizonyítékértékelő tevékenységhez, a bizonyítási eljáráshoz.
