A környezeti jogok értelmezése az Emberi Jogok Európai Egyezményébe foglalt jogok körében

Abstract

Jelen tanulmány a környezeti jogok, elsősorban az egészséges környezethez való jog kérdésével foglalkozik az idei évben 70 esztendős Emberi Jogok Európai Egyezményébe foglalt jogok kapcsán, az Emberi Jogok Európai Bíróságának gyakorlatában. A tanulmány számba veszi, hogy mely nevesített emberi jogok értelmezésében nyertek elismerést az egyének számára biztosított környezeti jogok.

The present study deals with environmental rights, especially the right to a healthy environment within the rights included into the celebrated European Convention on Human Rights (at its 70th anniversary) and within the practice of the European Court of Human Rights. This article analyses those explicitly recognised rights of the Convention which are interpreted as the frames of the (explicitly non-recognised) individual environmental rights.
