Abstract dc.description.abstract | A tanulmány a közigazgatási bíróság 1949-ben történt megszüntetése körülményeit és egyes következményeit levéltári, parlamenti és szakirodalmi források alapján vizsgálja. Három fő pont köré csoportosítottuk a kutatási eredményeket. Bemutattuk az 1949. évi II. törvény elfogadása és hatálybalépése körüli jogalkotási lépéseket, amelyek nyomán a közigazgatási bíróság helyébe lépett a pénzügyi és illetményügyi döntőbizottság, és azzal egyidejűleg megszűnt a korábbi bírói jogvédelem is. A levéltári dokumentumok feltárták előttünk, hogy a bíróság bírái és alkalmazottai milyen méltatlan helyzetbe kerültek a bíróság megszűnésekor. Megtörtént az a paradox helyzet, hogy több volt bírónak határozatban hívták fel a figyelmét arra, hogy „jogában áll a kézhezvételtől számított 15 napon belül az illetményügyi döntőbizottsághoz panasszal élni”. A dolgozatban ráirányítottuk a figyelmet arra, hogy a közigazgatási bíróság megszüntetésével egyidejűleg erősödött a közigazgatási hatóságok rendészeti jellege, és a járásbíróság hatásköréből a kihágások nagy része a rendőri büntetőbíráskodás (a rendőrség és a közigazgatási hatóság) hatáskörébe került át. This study focuses on the circumstances and effects of the cessation of the Administrative Court in 1949 sourced from archival, parliamentary and relevant literature. We classified the results of the research around three major points. We presented the legislative steps taken around the time the Act II of 1949 got accepted and went into effect. This Act replaced the Administrative Court with a financial and salary arbitration committee and erased the possibility of the judicature. The archive documents revealed that the judges and other employees were placed in a discreditable position. In the study we highlighted, that by the cessation of the Administrative Court, the administrative authorities gained executive power and the majority of misdemeanours previously handled by the district court, were handed over to the police and the administrative authorities. | hu_HU |
