A vámjogi környezet 25 évvel ezelőtt
Absztrakt :
Az 1991-es év kiemelt évnek
tekintendő. Mindenekelőtt azért,
mert 25 évvel ezelőtt, ebben az
évben alakult meg az akkori
Rendőrtiszti Főiskolán - az azóta
is változatlan elnevezéssel
működő - Vám- és Pénzügyőri
Tanszék. Ez a tanulmány emléket
kíván állítani a jeles évfordulónak
és bemutatni az akkori vámjogi
környezetet összefoglaló
jelleggel. A rendszerváltozás, a
társadalmi berendezkedés megváltozása természetesen maga után vonja a gazdaságpolitika
változásait is, ezen belül a kereskedelmi életét. Az államszocializmus megszűnése magával
vonta a kereskedelem liberalizációját is, azaz a külkereskedelem állami monopóliuma
megszűnt. Mindezzel természetesen együtt járt a vámjogi és vámeljárási szabályok módosulása
is. A magyar vámjogi szabályozás a piacgazdaságra való fokozatos áttérést nyomon kívánta
követni, ezért - mint a tanulmányban látni fogjuk - a kissé idejétmúlt szabályozás gyakori
módosítgatásával igyekezett lépést tartani a külkereskedelem változásaival. A külkereskedelmi
nagyvállalatok kizárólagos export-import tevékenysége megszűnt, a nemzetközi kereskedelem,
a „nyugati” országokba történő utazás lehetősége – némi korlátozással - alanyi joggá vált. A
tanulmány ezt a megváltozott környezetet kívánja bemutatni.
1991 shall be considered as a highlighted year. First of all, because – 25 years ago - in this year
the Customs and Finance Guard Department was formed (since then, its name has been
unchanged) in the Hungarian Police College. This study intends to commemorate this anniversary as well as presents and summarizes the
environment of the former customs law.
On the other hand, this year is also important because of the change of the political regime 181 .
The political transition and the change of the social conditions also cause automatically changes
in economic policy, specifically in trade life. The expiry of the state socialism brought the
liberalization of the trading i.e. the state monopoly of the external trade was defunct. All of
these have to be accompanied by changes of the rules of customs law and customs procedure.
The ruling of the Hungarian customs law intended to follow-up the gradual transition to the
market economy (as you will see in this study), so it endeavoured to keep pace with changes of
external trade with the regular modifications of the outdated regulation. The exclusive
competence to export-import activities of the external trade companies was defunct. The
international trade, the possibility to travel to the “countries of the West” – with a small
restriction - have to become as subjective rights. This study intends to present this changed
environment.
